English

Juridical independence in contemporary public rights, more than that merely administers the organizational position in judiciary, is related to capacities of courts to judge impartially and equally against disputers. Alawi’s tradition possesses the treasures of precise teachings about “equality in judgement”; teachings which if they pass beyond textual and ethical horizons, they will have capacities of formation in the position of an independent normative theory to explain juridical independence. The present paper, using the method of “restoration normative text-based”, firstly analyzes textually the letters and juridical accounts narrated from the Commander of the Faithful (a) in regard to legal denotations on independence and impartiality of a court, then it compares and re-forms them in the light of literature of contemporary public rights about juridical independence, fair judgement and impartiality of a court. The main finding of this research shows that one can exploit a theory from inside of Alawi’s tradition named as “justice of equality” in which juridical independence does not just mean an institution separated from other institutions, rather it means court’s commitment to four normative pillars: formal equality between disputers, prohibition any kinds of preference based on power and social states, equality in possibility of defense and to be heard and immunity of judge from power pressures for disturbing this balance. On this basis, the present paper indicates the theory of “justice of equality” can provide a native model to rethink about the legal necessities of juridical independence in Islamic Republic of Iran; a model which coincides with Alawi’s tradition and contemporary standards of fair judgement.
